Marine Mortgage Registration | BlueWater
A marine mortgage is a loan secured against your boat. Registration records the lender’s interest in an official ship registry. This article explains how marine mortgage registration works and how it is enforced.
What is a marine mortgage?
A marine mortgage is a legal document that gives a lender a security interest in your vessel. If you fail to repay the loan, the lender can take ownership or force a sale. It is similar to a house mortgage, but for a boat or yacht.
Why register a marine mortgage?
Registration makes your mortgage public. It warns other lenders and buyers that the vessel has an outstanding debt. Without registration, your lender’s claim may not be legally protected. Most banks require registration before they lend money for a yacht purchase.
Marine mortgage registration with BlueWater’s flag states
BlueWater offers marine mortgage registration for four flag states, each with unique advantages for enforcement and speed. These are the primary options we recommend and handle directly.
Polish registration
All documents must be in English or accompanied by a certified translation (not apostilled). Poland offers a moderate judicial procedure, with limited out-of-court sale possibilities.
San Marino registration
San Marino offers fast enforcement — out-of-court sale is possible under normal circumstances. There are no nationality or residency restrictions for yacht owners or crew members, and no annual renewal is required.
UK Part 1 registration
UK Part 1 registration is valid for 5 years and must be renewed after that period. Applicants must be ordinarily resident in the UK for 185 days in a 12-month period. The vessel must be less than 24 metres in length overall (LOA), used for pleasure or leisure purposes, and intended for use in international waters. Digital signatures are not accepted; all documents must be printed and signed.
Dutch Zeebrief registration
EU passport holders or passport holders from approved countries can register in their own name. The vessel must be intended for use in international waters. The Dutch Zeebrief offers fast enforcement with out-of-court sale possibilities.
Other flag states such as BVI, Cayman, and Marshall Islands also exist for marine mortgage registration, but BlueWater does not handle these registrations directly.
How marine mortgage registration works
Marine mortgage registration involves submitting the mortgage document to the ship registry of your chosen flag state. The registry records the lender’s interest on the official transcript of the vessel. This makes the mortgage public and legally enforceable.
Registration process per flag state
Each flag state has its own registration process. BlueWater prepares and notarizes the required documents and manages the submission process for you from start to finish.
Documents BlueWater prepares and notarizes
- Notarized Bill of Sale
- Notarized Builder’s certificate for new vessels
- Notarized Power of Attorney
- Deletion certificate from previous registry if applicable
Documents you, as the owner, must provide yourself include proof of ownership and evidence of the debt. Some flags also require a survey or valuation report.
Warning: Some banks require additional documents such as a marine survey or valuation report. Ask your lender for a complete document list before you start.

Documents you need
Before you enter into a marine mortgage, ensure you have the following documents ready:
- Proof of ownership (Bill of Sale)
- Evidence of the debt (loan agreement)
- Notarized Power of Attorney (prepared by BlueWater)
- Deletion certificate from previous registry (if applicable)
In most yacht registries, you cannot complete full yacht registration without proving ownership. If you cannot prove the VAT status of your yacht, customs authorities may request more documents and question whether the yacht can be used in EU waters.
Steps before entering into a marine mortgage
Before you enter into a marine mortgage, consider the enforcement risks. BlueWater helps owners understand these risks and how to avoid them.

- Ask BlueWater for a quote for document preparation. We prepare and notarize the required documents and manage the submission process for you.
