By accessing, using or placing an order through our Service, you confirm that you have read, understood and accepted these Terms.

1. Nature of the Services

BlueWater Registration Services BV provides administrative coordination services relating to yacht registration, documentation handling and related maritime compliance processes.

We are not:

A maritime authority
A flag state administration
An insurer
A classification society
A law firm

Final decisions regarding registration approval remain solely with the relevant maritime authority.

2. Orders and Payments

When placing an order (“Purchase”), you may be required to provide payment details and identification information.

You represent and warrant that:

You have the legal right to use the payment method provided;
All information submitted is accurate, complete and truthful.

We reserve the right to refuse or cancel an order if incorrect, incomplete or misleading information is provided.

Unless otherwise agreed in writing, payment must be completed before submission to the relevant authority.

3. Client Responsibilities

The client is responsible for:

Providing complete and accurate information;
Supplying valid and authentic documentation;
Responding timely to requests for additional information;
Complying with applicable maritime and regulatory requirements.

BlueWater Registration Services BV is not responsible for delays or rejections resulting from inaccurate, incomplete or misleading information provided by the client.

4. No Guarantee of Timeline or Outcome

While we perform our services professionally and diligently, we do not guarantee:

Processing timelines set by maritime authorities;
Future regulatory stability;
Acceptance by banks, insurers or third parties.

All registration decisions remain at the discretion of the relevant authority.

5. Money Back Guarantee

BlueWater Registration Services BV offers a full refund guarantee in the event that the relevant maritime authority formally confirms that a properly submitted yacht registration application cannot be approved.

In such case, the client is entitled to a refund of the full amount paid for the specific order.

This guarantee applies only where:

The application has been properly submitted to the relevant authority;
The rejection is formally issued by that authority;
The rejection is not caused by incorrect, incomplete or misleading information provided by the client.

This guarantee does not apply if:

The client voluntarily cancels the order after payment;
The client fails to provide required documentation;
The client provides inaccurate or misleading information;
The client chooses not to comply with additional lawful requirements imposed by the authority.

The refund under this clause is strictly limited to the total amount paid for the specific order. No additional compensation, damages or financial liability shall arise beyond the refund of the paid amount.

6. Limitation of Liability

6.1 Maximum Liability

By accepting these Terms, the client explicitly agrees that BlueWater Registration Services BV shall, to the fullest extent permitted by applicable law, never be financially liable for any amount exceeding the total invoiced amount paid by the client for the specific order to which the claim relates.

This limitation of liability forms an essential part of the agreement between the parties. Without this limitation, BlueWater Registration Services BV would not enter into the agreement.

6.2 Scope of Application

This limitation applies to all forms of liability, including but not limited to:

Contractual liability
Statutory liability
Tort-based liability
Improper performance
Non-performance

Regardless of the legal basis of the claim.

6.3 Excluded Damages

Under no circumstances shall BlueWater Registration Services BV be liable for:

Indirect or consequential damages;
Loss of profit, revenue or business opportunities;
Regulatory fines imposed on the client;
Costs arising from regulatory changes;
Inspection or compliance costs imposed by authorities;
Third-party financial losses.

6.4 Exception

Nothing in these Terms excludes liability in cases of wilful misconduct or gross negligence where exclusion is not permitted under applicable law.

6.5 Time Limitation

Any claim must be submitted in writing within 30 days after the event giving rise to the claim is discovered or reasonably should have been discovered. Claims submitted after this period are void.

7. Dealer and Referral Partnerships

Dealer partnerships operate under structured cooperation models.

For referral partners:

Commission is allocated according to the agreed referral structure;
Misuse of referral codes may result in suspension.

For white-label partners:

The dealer retains responsibility for client pricing;
BlueWater Registration Services BV acts as backend service provider.

Dealer cooperation does not create employment, agency or joint venture relationships.

8. Intellectual Property

All website content, platform systems, branding and materials remain the exclusive property of BlueWater Registration Services BV.

Unauthorized reproduction or use is prohibited.

9. Third-Party Links

We are not responsible for third-party websites, services or content.

10. Termination

We reserve the right to suspend or terminate access to our Service in case of violation of these Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of The Netherlands.

Any dispute shall be submitted exclusively to the competent court in The Netherlands.

12. Amendments

We reserve the right to update these Terms at any time. Continued use of the Service constitutes acceptance of revised Terms.
